Famzam.com, LLC and Incentive Logic, Inc. have entered into a partnership that will offer One (1) promotional gift card for when a Famzam member invites and connects with 15 new registered members in their Famzam network (existing members do not qualify). This offer is for a limited time only and valid only for Famzam members in the U.S. only. Promotion gift cards cannot be redeemed for cash and if lost or stolen will not be replaced. Once the Famzam member reaches their benchmark and receives their Giftfolio package through email they can select the gift card of their choice. All gift cards will be sent out by Incentive Logic and should arrive within 7 to 14 business days. Famzam reserves the right to have a maximum of 90 days to fulfill all gift card requests. Customers may not redeem them until they receive the physical gift card in the mail.

TERMS AND CONDITIONS FOR PROMOTIONAL GIFT CARDS AND EMAIL GIFT CARDS ISSUED BY FAMZAM.COM, LLC AND INCENTIVE LOGIC, INC.

The following terms and conditions (the "Agreement") apply to any Famzam gift card or email gift card given by Famzam for free, including "free with purchase," or distributed as a reward, incentive, part of a marketing program or promotion or otherwise (the "gift card").

1. By accepting and retaining the gift card or using the gift card, you agree to these terms and conditions, as well as future terms and conditions and program/service changes related to this gift card campaign. Famzam reserves the right to change the format, elements, terms and conditions, and terminate the gift card program at any time without notice. The gift card and associated offers are void where prohibited by law. The terms "you and your" mean the person to whom the gift card was issued.

2. Use of the gift card is limited to the amount of funds associated with the gift card. You cannot increase the funds on the gift card. This gift card is intended for use as a gift to an individual. Resale of this gift card or use for unauthorized advertising, marketing, sweepstakes or other promotional purposes is strictly prohibited. Gift cards may not be used to purchase other Famzam gift cards. You may not permit any other person to use the gift card issued to you. Your right to use the funds on the gift card is a limited right, subject to the terms and conditions of the Agreement and applicable law. Please note that purchases made with the gift card are similar to those made with cash in that you cannot "stop payment" on such transactions. Famzam.com is not responsible for errors or omissions. The full amount of each purchase, including taxes, will be deducted from the funds held on the gift card, up to the total funds available on the gift card.

3. The laws of New Jersey govern the gift card and the terms and conditions of this Agreement.

4. Please note that the gift card has an expiration date. Please refer to the terms and conditions of the promotional offer for the expiration date of the gift card. After that date, the funds will expire, and the gift card will not be accepted any of the selected merchants. After the expiration date, please cut up the gift card and dispose of it. Invalid gift cards are not replaceable or returnable.

5. You agree to use the gift card only for legitimate purchases only and may not return merchandise or cancel services obtained with the gift card for a cash refund.

6.. If you attempt to use the gift card for an amount greater than your available fund balance, the transaction, in most cases, will be declined. To use supplemental payment, you should instruct the selected merchant to apply an amount not to exceed the funds available on the gift card, and inform them that you will pay the balance using a different method of payment.

7. You should safeguard the gift card from unauthorized use. It is your responsibility to keep the card in a secure place. If you lose the card, it is gone, and will not be replaced.

8. This gift card promotion is designed to provide a benefit to our individual customers. These promotional gift cards are not transferable and have no cash value. Famzam.com and Incentive Logic reserves the right, in its sole discretion, to refuse to honor any gift card that is used in a manner inconsistent with these objectives, including without limitation any fraudulent use. If Famzam suspects misuse of the ‘Grow Your Network’ promotion or the use of any gift card, it may be suspended or terminated. The Famzam Administrative Team will check the authenticity of all family/friend networks once the 15 new member benchmark is reached. Famzam reserves the right to decline a gift card to any member if the company believes a fraudulent act is purposely taking place. The company will notify the member in full detail of the reason why they are disqualified from the gift card promotion. All disputes are made final by Famzam. Famzam will also pursue any legal action against the accused for fraudulent activities and all cost incurred with this legal action will be paid by the accused. Famzam will not tolerate any member trying to create false networks in order to take advantage of their gift card promotion. If Famzam believes fraud to be taking place, they can delete the members account at anytime and ban them from using the site in the future.

9. As part of providing you with the gift card, we may obtain personal information about you which we use on Famzam’s behalf to support and enhance your use of the gift card.
